1) Overview
These Terms govern your access to and use of TrustPop.io (the “Service”), a software-as-a-service platform provided by BDigital LLC. By using the Service, you accept these Terms.
Albania compliance notice: Online providers must display clear provider identity and pre-contract information; electronic contracts are recognized; and mandatory consumer rights (where a natural person acts outside trade/profession) cannot be waived.

3) The Service
TrustPop.io offers: (a) real-time social-proof notifications (e.g., recent activity, visitor counts), (b) customization/branding tools, and (c) analytics and integrations. Features may evolve over time.
4) Accounts & Eligibility
You must provide accurate registration details, keep credentials confidential, and be legally capable to contract. You’re responsible for activity under your account.
5) Acceptable Use
You agree not to: (i) breach applicable law or third-party rights; (ii) engage in spam, malware, or system interference; (iii) probe/circumvent security; (iv) misuse APIs, webhooks, or tracking code; or (v) introduce content that is unlawful or infringes IP.
6) Plans, Billing & Taxes
- Subscriptions are monthly or annual, billed in advance via Paddle.
- Current pricing appears at trustpop.io/pricing (subject to change).
- Prices may be shown exclusive or inclusive of taxes; applicable taxes/withholding are your responsibility unless the site states otherwise.
- No refunds for partial periods or downgrades, except where mandatory consumer law requires otherwise (see Section 7).
7) Trials, Cooling-Off & Consumer Withdrawal (Albania)
If you are a consumer in Albania entering a distance contract for the Service, you may have a 14-day right of withdrawal from contract conclusion unless you request immediate performance and acknowledge you lose the right once performance starts, or another statutory exception applies for digital services. To withdraw, email [email protected] with a clear statement before the period expires. Where valid, refunds will be processed within the statutory timeframe to the original payment method. (Business users/non-consumer transactions have no statutory cooling-off right.)
8) Intellectual Property
All software, code, features, designs, trademarks, and content of the Service are owned by BDigital LLC or licensors. We grant you a non-exclusive, non-transferable right to use the Service during your paid plan. No reverse engineering except where a restriction is prohibited by law.
9) Third-Party Services
Some features rely on third parties (e.g., payment processors, analytics, integrations). Their terms and privacy practices apply to those components; we’re not responsible for third-party services we don’t control.
10) Privacy & Data Protection
Personal data is processed under our Privacy Policy (linked on the site). Albania’s personal-data regime applies; Albania enacted a new GDPR-aligned law (Law No. 124/2024) published January 2025, which updates controller/processor duties, data subject rights, and enforcement. Cross-border transfers rely on appropriate safeguards identified in the Privacy Policy.
11) Security & Availability
We implement reasonable technical and organizational measures but do not guarantee uninterrupted or error-free operation. You should maintain independent backups where appropriate.
12) Suspension & Termination
We may suspend or terminate access for breach of these Terms, legal risk, non-payment, or security concerns. You may cancel any time in your dashboard; access continues until the end of the paid term. Termination does not create refund rights beyond Section 7 (where applicable).
13) Warranties & Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, and non-infringement). This does not affect rights that cannot be disclaimed under mandatory consumer law.
14) Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability for all claims in any 12-month period is limited to the fees you paid for the Service in the three (3) months before the event giving rise to the claim. We are not liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, data, or goodwill. Any limitation applies only to the extent allowed by mandatory consumer law.
15) Indemnity (Business Users)
If you use the Service for business, you will defend and indemnify BDigital LLC against third-party claims arising from your content, unlawful use, or breach of these Terms.
16) Changes to the Service or Terms
We may modify features or these Terms to reflect operational, legal, or security needs. We’ll post changes with an updated Effective Date and provide advance notice for material changes where required. Continued use after changes means acceptance.
17) Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Albania (without reference to conflict-of-law rules).
- Business users: exclusive venue in the competent courts of Tirana, Albania.
- Consumers: you retain your mandatory protections under Albanian consumer law and may bring claims before competent Albanian authorities or courts as permitted by those laws.
18) Electronic Communications & Contracting
You consent to receive notices electronically (email, in-app, or website). Electronic contracts and electronic signatures including advanced and qualified e-signatures are recognized by Albanian law and may be used to conclude agreements and provide notices, subject to statutory exceptions.
19) Assignment, Force Majeure, Entire Agreement
You may not assign these Terms without our consent; we may assign to an affiliate or in connection with merger, acquisition, or asset sale. Neither party is liable for delays/failures due to events beyond reasonable control. These Terms (plus any Order/Service confirmation and the Privacy Policy) form the entire agreement and supersede prior arrangements on the same subject.
